Senator Chuck Schumer (D-NY) is leading an effort that challenges not only a state's ability to protect itself from the impacts, both from a financial and security perspective, of illegal immigration, but his plans also challenge the architecture of checks and balances established by the U.S. Constitution.
Sen. Schumer says he wants to overturn a Supreme Court ruling last year that allowed states to require businesses make sure that their employees have legal status in the U.S., and made overtures that Congress should be prepared to overturn future rulings that give states the right to enforce immigration laws.
Speaking at a Senate hearing on Arizona's 2010 Immigration Law, Schumer said, "I believe it is simply too damaging to our economy and too dangerous to our democracy to have 50 states doing 50 different things with regard to immigration policy."
The hearing comes a day before the Supreme Court hears oral arguments regarding Arizona's immigration law. In the event that the court comes down on the side of the state, Schumer plans to introduce a bill that would also overturn another high court case last year that upheld another Arizona law requiring businesses to use E-Verify, a program that has a better than 90% accuracy rate.
No Republicans attended today's hearing. Senator Jon Kyl, (R-AZ), is the second-ranking Republican in the Senate. He reportedly said none of his fellow Arizona lawmakers were consulted before the hearing, which he said "demonstrates that it is intended to be more of a spectacle than a forum for learning anything useful.
